Alabama Transgender Minors Law Sparks: The Biden DOJ’s move to block Alabama’s prohibition on sex change procedures for transgender minors has placed Dr. Rachel Levine, Assistant Secretary for Health and Human Services, in legal proceedings. A judge compelled Levine, a prominent transgender official, to be a custodian in this case.
Alabama’s attorney general, Steve Marshall, is actively defending the state’s law, making it a felony to prescribe puberty blockers or hormones for sex changes in transgender minors, carrying a penalty of up to 10 years in prison.
The DOJ sought to be a party in the lawsuit against Alabama’s law, subjecting some federal officials to discoverya process where evidence is presented and requested before trial. Marshall then requested Levine’s records, considering her a key advocate for sex changes in children with gender dysphoria in the federal government, particularly in the Health and Human Services Department.
The DOJ attempted to block the request, offering Levine’s former subordinate for discovery and providing a FOIA response with unrelated search terms. However, on Nov. 17, a court ruled that Admiral Levine’s emails are relevant, considering her a public official.
Alabama Attorney General Marshall expressed satisfaction with the court’s decision, stating, “We look forward to reviewing the documents HHS produces as we continue to defend Alabamas children.
The DOJ declined to comment, and HHS has yet to respond. Levine has been a prominent voice in the federal government on transgender issues, according to the attorney general.

“Levine has been at the forefront of the Biden Administrations reckless promotion of sex-modification procedures for children. There is no doubt about that, nor about the Admirals close involvement with radical organizations like WPATH whose Standards of Care mandate the use of sterilizing hormones and surgeries to treat vulnerable children suffering from gender dysphoria,” he asserted.
In August, Levine praised an Alaska gender clinic for promoting revisionist ideas about biological sex. This included eliminating the word “mother” from K-12 science classes. The gender-inclusive biology curriculum recommended “child-friendly definitions” of terms related to gender and sexuality.
In July, Levine argued that medical interventions like hormone therapy might be necessary for children experiencing the “wrong puberty.” In March, Levine promised that medically changing kids’ genders would soon be normalized, expressing optimism about the future.
